BATC v. DLI Technical Fix Finalized in 2017

Following the BATC v. DLI court case where the sprinkler mandate was struck down in one and two-family homes, a technical issue remained—the court decision and code definition weren’t aligned.

The Minnesota legislature has addressed this technical issue with House File 792, authored by Rep. Tama Theis (R-St. Cloud) and Sen. Rich Draheim (R-Madison Lake). This bill, which was signed by Gov. Dayton on May 2, requires rulemaking to bring the definition of a townhome back to the national standard of three units or more, which means that sprinklers would no longer be required in two-family twin homes.
